    LOST AND DAMAGED MERCHANDISE

THE RESPONSIBILITY OF THE PERLICK CORPORATION CEASES UPON ACCEPTANCE OF ITS PRODUCTS BY THE CARRIER. Any damage or loss sustained in shipment is the carrier’s responsibility. Before giving the carrier a clean receipt at time of delivery, make sure you receive every item on the bill and inspect every carton, crate, and box for concealed damage, e.g., broken boards, crushed or punctured cartons, torn cardboard. IF ANY ITEMS ARE SHORT OR DAMAGED, DO NOT ACCEPT THE SHIPMENT UNLESS THE CARRIER MAKES A NOTATION OF THIS ON YOUR FREIGHT BILL. Then request an inspection. Do not destroy the packing materials. If their agent does not make an inspection within five days, advise the carrier via letter that you notified them regarding the matter and that they have failed to act. You will need this letter to support your claim. Then file a claim for your loss. When you give the carrier a clean receipt, you accept the total responsibility for the shipment. UPS shipments are insured individually, and UPS will replace all merchandise that is lost or damaged.

    RETURN OF MERCHANDISE

Freight charges must be prepaid on all return shipments. When a return is authorized, a credit may be allowed pending an examination of the returned goods. The amount of the restocking charge will depend on the condition of the equipment. The minimum restocking charge for glasswashers, bottle coolers, frosters, direct draws, cooler series back bars, and accessory parts is 20%. The minimum restocking charge for custom series cabinets is 50%. The minimum restocking charge for unassembled, freestanding underbar stainless steel modules is 20%. Limited Warranty Within The United States & Canada

Isenberg Bath Corp. (“Isenberg”) products have been manufactured under the highest standards of quality and workmanship.

Isenberg warrants to the original consumer purchaser for as long as the original consumer purchaser owns their home (the “Warranty Period” for homeowners), that the Isenberg product that he/she has purchased will be defect free during normal use and all parts and finishes of this product will be free from defects in material and manufacturing workmanship. All other purchasers (including purchasers for industrial, commercial and business use) are warranted for a period of 2 years from the original date of purchase (the “Warranty Period” for non-homeowners).

If the product should ever develop a defect during the Warranty Period, Isenberg will provide the parts necessary to put the product back in good working condition FREE OF CHARGE, under normal installation, use and service.

This warranty is subject to the limitations of liability noted below.

    Limitations of Liability

This warranty is applicable only to Isenberg products purchased after 1st January, 2011 and shall be effective from the date of purchase as shown on the purchaser’s receipt. It applies only to Isenberg products purchased from Isenberg directly or from an Isenberg authorized dealer, and installed in the United States or Canada. This warranty is non-transferrable.

The Warranty Period for drain assemblies, bathroom hoses, hand-helds, kitchen hand sprays and kitchen hoses shall be limited to a period of 1 year from the original date of purchase.

This warranty is extensive in that it covers replacement of all defective parts and finishes, but these are the only two things that are covered. Damage due to installation error, product abuse, product misuse, or use of cleaners containing abrasives, alcohol or other organic solvents, whether performed by a contractor, service company, or you, are excluded from this warranty.

Further, this warranty will not apply if you do not use the product in its entirety. If any part (including but not limited to a cartridge, hose, handle, o-ring, aerator, flow limiting restrict-or, etc.), is not installed, removed, or replaced by a non-genuine Isenberg part, this warranty will be voided.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. EVEN IF THIS WARRANTY IS DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL ISENBERG’S ENTIRE LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT WARRANTED HEREUNDER.

THIS WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES NOT EXPRESSLY SET FORTH HEREIN, WHETHER EXPRESS OR IMPLIED, BY OPERATION OF LAW OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT THAT ANY IMPLIED WARRANTIES MAY NONETHELESS EXIST BY OPERATION OF LAW, ANY SUCH WARRANTIES ARE LIMITED TO THE DURATION PROVIDED BY THAT LAW. Avenue, Miami, Florida 33142. Atlantis Tubs reserves the right to
inspect the malfunction or defect on location.

      RESPONSIBILITIES OF OTHERS
Inspecting the unit prior to installation is the responsibility of the
installer or building contractor who acts on behalf of the user. They
are responsible for ensuring the unit is free of defect or damage.
Notices are placed on and in the unit and on the shipping carton
advising the installer of this responsibility. In the event of a problem,
the unit must not be installed. Atlantis Tubs is not responsible for
failures or damage that could have been discovered, repaired, or
avoided by proper inspection and testing prior to installation.

Damage occurring in transit is the responsibility of the carrier.
The user or installer MUST open the crate and inspect the unit
for damage when it is delivered. If damage is discovered, it must
be reported immediately to the seller and the carrier in writing,
and an inspection requested. Failure of the carrier to respond
should be reported to the seller and the carrier. Your freight
claims should be filed promptly thereafter.

      Lexora

      WARRANTY
All Lexora products carry a 1-year manufacturer’s limited warranty. Proof of purchase, such as a receipt from the original retailer, will be required for all warranty claims. This warranty covers products that were properly installed by a licensed professional and used properly. If, under those circumstances, a Bell and Modern product has a manufacturer’s defect, Lexora will provide the parts necessary to resolve the issue free of charge. This includes a full replacement of the product if necessary, solely at the manufacturer’s discretion. If an item is defective upon receipt, do not install and contact Lexora immediately. Defective items that are knowingly installed will not qualify for free replacements.

Damage due to installation error, product abuse or misuse, or use of cleaners containing abrasives, alcohol or other organic solvents — whether performed by a contractor, service company or yourself — are excluded from this warranty. Additionally, defects or damage caused by non-Lexora parts will void this warranty in its entirety.

Lexora will not be held responsible for labor charges and/or damage incurred during the installation, repair, or replacement of any Lexora product. Furthermore, the manufacturer shall not be held responsible for any incidental or consequential damages, losses and/or injury relating to the item(s).  Except as provided by law, this warranty is in lieu of and excludes all other warranties, conditions and guarantees — whether expressed or implied, statutory or otherwise — including without restriction those of merchantability or of fitness for use.

Depending on jurisdiction, some states, provinces, and countries do not allow the exclusion or limitation of incidental or consequential damages. In such cases, the aforementioned limitations or exclusions may not apply. This warranty affords you specific legal rights; you may have other rights which vary from state to state, province to province, and country to country.

All Lexora products (with the exception of our outdoor firepits) are designed for indoor use only.  All warranties are non-transferable. Lexora will supply proper instructions for making warranty claims. Please contact us to start the warranty process.
